
Federal immigration authorities have detained former Coldwater mayor Joe Ceballos after he admitted to voting illegally as a noncitizen in several Kansas elections, according to court records and statements from his attorney.
Ceballos, 55, was taken into custody by U.S. Immigration and Customs Enforcement during a scheduled meeting at an ICE office in Wichita, Kansas, on Wednesday. His attorney, Jess Hoeme, said the former mayor now faces possible deportation proceedings despite previously reaching a plea agreement in state court. (AP News)
Born in Mexico, Ceballos has lived in the United States since childhood and holds lawful permanent resident status, commonly known as a green card. He served on the city council in Coldwater before being elected mayor twice in the small conservative Kansas community.
Guilty Plea Stemmed From Noncitizen Voting Case
The legal case against Ceballos began after he disclosed during a citizenship interview in 2025 that he had voted in elections while believing his permanent residency status allowed him to participate legally.
Kansas Attorney General Kris Kobach later charged him with election-related offenses tied to voting in multiple elections despite not being a US citizen.
Initially, prosecutors filed felony charges including election perjury and unlawful voting allegations. However, Ceballos eventually pleaded guilty in April to three misdemeanor counts of disorderly election conduct under a plea agreement that avoided jail time. (The Washington Post)
Under the deal, he received a suspended six-month sentence, one year of probation, and a $2,000 fine.
His attorney has argued that the voting violations resulted from an “honest mistake” rather than deliberate fraud, stating that Ceballos believed he was legally eligible to vote after registering as a teenager during a school activity.

Ceballos’ detention has generated strong reactions in his hometown and among immigrant advocacy groups.

Immigration attorneys representing Ceballos said they plan to request a bond hearing before an immigration judge.

The case has drawn national attention as President Donald Trump and Republican officials continue emphasizing election security and noncitizen voting enforcement.
Kansas Attorney General Kris Kobach, a longtime advocate for stricter voting laws and immigration enforcement, has argued that cases involving noncitizen voting demonstrate the need for stronger voter verification systems.
Critics, however, say documented cases of noncitizen voting remain rare and warn that aggressive enforcement measures could discourage lawful immigrant participation in civic life and naturalization processes.
Legal experts note that noncitizens convicted of falsely claiming US citizenship or unlawfully voting can face immigration consequences, including removal proceedings, under federal immigration law.
Ceballos’ immigration case remains pending, and ICE officials have not publicly confirmed where he will ultimately be transferred during detention.
